Q.... If a truck is under hire or long term lease is the hiring company obliged to place road tax on it ??

A.... NO After making enquiries from a few places it has become clear that in the small print of most hire contracts states that the truck will be used in the confines of the factory and if it is to be used on the road it will be up to the hirer to make good any additional requirements such as road tax.

Q.... If I work in Europe does the licence and certificate allow me to drive Lift Trucks without an additional test ??

A.... NO The standard of instruction is ultimately laid down and approved by the UK government of the day. This is not necessarily recognised in Europe. It is the same for workers coming to the UK.

Q... If my Lift Truck  has a seat belt do I need to wear it??

A... YES  If the truck is fitted with one then use it.

Q...Do you have to wear a seat belt when you are reversing a fork lift??

A... YES  For seat belt read "seat restraint". In practice this is a lap strap. On the purpose build designs it is a self tightening non- restrictive design allowing for free movement. Even backwards.

Q... Do all counterbalance trucks need a belt??

 A... YES It will be an offence for an employer not to provide a belt on a truck after 5th Dec this year. 

Q... Do I need to convert my fleet of Reach Trucks to have Seat Belts ??

A... First of all the requirement is to provide "restraint" to prevent injury from basically "the mouse trap" and that dose not necessarily mean a seat belt. Secondly Reach trucks have been risk assessed as not needing a restraint. In fact it could be more detrimental to the operator should the worst happen.

Q... When did the new code of practice start??

A... Now on 17th July 1999

Q... When was the new test  introduced??

A... End April 2000

Q.. Are there age limits regarding fork truck operation ??

A...YES ! Ages and limits in principal are the same as a car license for old and young. All young persons (under18) if they have a ticket ,can drive as long as they are supervised. Any  medical requirements are the same as for the public highway.

Q...Can I drive a forklift without a licence??

A...NO. Regulation 9 of "Provision and use of work equipment regulations 1998 (PUWER)" requires that: Every employer shall ensure that all persons who use work equipment have received adequate training for purpose........................
Approved code of practice (ACOP) states Employers should not allow anyone to operate, even on a very occasional basis, lift trucks within the scope of the ACOP who have not satisfactorily completed basic training and testing as described in the ACOP

 

Q... Do you have to carry you licence with you when operating a forklift?.

A...NO But some individual employers may require that.

Q... Do you have to have hand pallet trucks tested and or inspected and a record kept??

A...YES. It has to have a service record maintained under the LOWLA Regs

Q... If a truck has an attachment and no de-rating plate atached to the truck should I drive it??

A... NO It states clearly in HSG6 Safety in working with Lift Trucks (ISBN 0717617815)  P23 section 67 that one should be attached.

Q... How is a rated capacity worked out for an attachment??

A... Check your trucks Rated capacity plate.
 Find a; The trucks lifting capacity (mast vertical)
         b; At what load centre. (load centre being the distance from fork face to c of g of load.)
         NOTE... RATED Capacity is overall rating
                       ACTUAL capacity will be lower. (accounting for side-shift ect)
An Example if not stated on De-rating plate to help......
Let us assume that your truck has an actual capacity of 2000kg at a load centre of 500mm and apply the law of leverage which states "Double the distance Half the weight" it follows that if we lift at a Load centre of 1000mm then we can only handle 1000kg.Or 2000mm would reduce us to 500kg.You can then work out what each 100mm costs us in lost capacity. In this case I can say my truck loses 200kg per 100mm. I am now in a position to work out what my capacity is for my fork extensions. We then simply need to reduce the figure by the weight of the extensions as well to have our new capacity figure.

Q... Do the operators who use lift cages only, have to have the normal test for the refresher course or is there a different one applicable because they don't move loads just the cage truck.??

A... Specific training is possable with manouvering skills only but for lifting people in cages  full training would be neccessary, in order to provide "adequate training" as required by HASWA 74

 

Q... Dose a fork lift needs to be licensed if it is carrying out a limited amount of work on the highway immediately adjacent to the business premises.??

A.. Yes

Q... Originally trained and assessed by a in-house qualified instructor who left 9 year ago. Are we still fully qualified. ??

 

Q... Does an employee who has been trained on a Category B1 Electric Counterbalance need conversion training to drive a category B1 internal combustion engine truck??

What license do I need to operate mobile plant in the workplace?

There are no government issued licenses for vehicles at work, the law requires that each operator is given adequate training by their employer so that they are competent to operate the machinery which they use (the Provision and Use of Work Equipment Regulations 1998; regulation 9).

The Health and Safety Commission (HSC) has recognised six bodies - as the remainder of the paragraphs will explain the six bodies.

I work for a company which runs its own in house training scheme which is not accredited by any of these bodies. Is this legal?

As long as the training you are given means that you are competent to operate the machinery you use safely, then there is no absolute legal duty to use the accredited system.


I operate plant other than lift trucks, what is the licensing system for that?

There is no HSC approved system for training plant operators other than lift truck operators. There is still a legal duty for every employer to ensure that their employers are adequately trained for the machinery they operate (Provision and Use of Work Equipment Regulations 1998 regulation 9), there are many different schemes in operation, each employer should satisfy themselves that training under the schemes they accept means that operators are competent to use each piece of equipment that they will be required to operate.


My employer will not accept my training certificate as valid, and is insisting that I retrain to a different scheme. Is this legal?

Employers are entitled to require their plant operators to be trained to any scheme which they think is appropriate to their workplace, as long as completion of the training certificate the company chooses means that employees are competent to operate the mobile plant they will be using.

For rider operated lift trucks, the HSE recognizes each of the five accrediting bodies equally, but has no powers to dictate to companies which of the schemes they accept.


Do I need a valid UK car driving license in order to operate plant in the workplace?

No, driving a car and operating mobile pant are very different tasks, although they use some of the same skills. There is no legal requirement for plant operators to hold a road driving license unless they wish to drive their vehicles on the public highway. All plant driven on the public highway must comply with the appropriate road traffic legislation.


I have moved jobs and lost my lift truck training certificate. Can I get a copy from HSE?

There is no state system for training of lift truck operators as there is for drivers on the public highway. There is therefore no central organisation which holds copies of training certificates. To obtain a duplicate of your certificate of basic training you will need to contact the training provider who trained you and issued the original, or your previous employer, or the body which accredited the training. If you cannot obtain a duplicate then your new employer may wish to have you assessed and re-tested.


It is over three years since I did my basic lift truck training. My employer has refused to send me on refresher training. Is he obliged to provide additional training?

There is no specific requirement to provide refresher training after set intervals, but even trained and experienced lift truck operators need to be re-assessed from time to time to ensure that they continue to operate lift trucks safely. In addition to routine safety monitoring, re-assessment might be appropriate where operators have not used trucks for some time, are occasional users, appear to have developed unsafe working practices, have had an accident or near miss, or there is a change in their working practices or environment.


I have never had any formal training to drive a lift truck. What are the legal requirements?

Your employer has a general duty under section 2 of the Health and Safety at Work etc Act 1974 to provide information, instruction, training and supervision to ensure the health and safety of their employees. Under the Provision and Use of Work Equipment Regulations 1998 employers are required to "ensure that all persons who use work equipment have received adequate training for purposes of health and safety, including training in the methods which may be adopted when using the work equipment, any risks which such use may entail and precautions to be taken." The Management of Health and Safety at Work Regulations 1999 also places duties on employers to provide training for lift truck operators. By not providing you with any training at all, your employer could be breaking the law.
